Blissful Place Pty Ltd

SUBCONTRACT AGREEMENT

This Agreement establishes the terms and conditions between Blissful Place Pty Ltd, referred to as the "Company," and the "cleaner" signing this agreement, referred to as the "Subcontractor and employee." The cleaner's acceptance of these terms and conditions is confirmed by selecting the "yes" check box during the signup process on Blissful Place's website/platform. 

1. Parties involved

1.1 Blissful Place: Blissful Place Pty Ltd is an Australian company registered and operated in Western Australia. The organisation employs cleaners to provide cleaning services for its clients.
1.2 The cleaners undertake to provide services to Blissful Place's clients in accordance with the terms and circumstances outlined in this Agreement, the Terms and Conditions of the platform, and the Privacy Statement.

2. The range of services

2.1 The cleaners agree to perform services for the clients of Blissful Place under the instructions provided by the Company. The services will encompass standard cleaning duties such as carpet cleaning, commercial cleaning, vacate cleaning and residential cleaning as outlined by the company.
2.2
The cleaners acknowledge that Blissful Place may have specific requirements or regulations regarding the cleaning services; and, they pledge to comply with these regulations.

3. Engagement and arrangements for work 

3.1 To comply with tax regulations, the subcontractor agrees to work as a subcontractor and will utilise their Australian Business Number (ABN).
3.2 The cleaners are required to furnish their own cleaning products and tools, as specified by Blissful Place. The company has the authority to instruct cleaners on the specific tools or supplies required for tasks.

4. Making private plans is not allowed 

4.1 The cleaners agree to refrain from engaging in any clandestine arrangements with clients of Blissful Place for cleaning services that are outside the scope of this agreement.
4.2 Blissful Place possesses the ownership of both customers and cleaners.

5. Responsibility for damage 

5.1 The cleaners acknowledge sole liability for any work-related losses or damages incurred during the cleaning process.
5.2 Blissful Place shall not be liable for any damages resulting from the negligence of the cleaners.

6. Termination

6.1 This Agreement shall remain in effect until one party provides written notice to the other party expressing their intention to terminate it.

6.2 In the event of a breach of the terms and conditions outlined in this agreement, Blissful Place is entitled to immediately enforce this agreement.

7. Laws that apply

 7.1 This Agreement will be governed by and interpreted by the laws of Western Australia, or any other relevant laws in Australia.

8. The Whole Deal

8.1 This Agreement represents the sole mutual agreement between the parties (the cleaners and the company) about the matters discussed within it. This document supersedes all prior agreements, understandings, negotiations, and talks, regardless of whether they were documented in writing or conveyed orally.

9. Your legal obligations

9.1 The cleaners are responsible for adhering to the legislative restrictions on working rights.

9.2 It is necessary for all the information submitted during the signup process on Blissful Place's platform to be honest and truthful. Hence, if you modify your address, name, mobile number, email, visa conditions, police check, etc., it is imperative that you promptly inform Blissful Place.

10. Cleaning equipment

10.1 The cleaners are required to possess all the essential equipment, as defined by Blissful Place, at the workplace.

10.2 In the event that a task remains unfinished owing to a lack of equipment, it is the exclusive responsibility of the cleaners to complete the task.

11. Cancelling an accepted job

11.1 Blissful Place discourages the cancellation of accepted and planned jobs unless there is a compelling reason.

11.2 The cleaners are responsible for promptly notifying both the customers and the office in the event of a last-minute cancellation.

12. Going on leave or planning to quit the job

12.1 The cleaners are required to inform the office of their leave at least two weeks in advance to allow sufficient time for essential preparations.

12.2 If the cleaners wish to terminate working with Blissful Place, cleaners are required to provide a minimum notice period of two weeks to Blissful Place and must also return any assets belonging to Blissful Place.

13. Payment/wage

13.1 Blissful Place holds the power to adjust the rate, either to increase or decrease it, based on the prevailing market price.

13.2 Blissful Place will pay the subcontractors, including the Goods and Services Tax (GST), at a rate of 10% for each shift, if their ABN is GST registered.
13.3
A complaint from the customers will result in Blissful Place exercising its authority to withhold payment. To address the complaints, the cleaner in question must resume work to address the complaint.   

This Agreement is executed on the date when the cleaners select the option "yes" on Blissful Place's website during the sign-up process. By selecting "yes", the applicant affirms that they have perused, comprehended, and consent to be legally obligated by the terms and conditions of this Agreement.
